Terms of Service
These Terms explain the rules that apply when organizations and authorized users access Worklix, including account responsibilities, workforce monitoring, subscriptions, customer content and acceptable use.
These Terms should be read together with the Worklix Privacy Policy, Cookie Policy, Acceptable Use Policy and any signed order or commercial agreement that applies to your account.
1. Agreement to these Terms
These Terms govern access to and use of the Worklix website, applications, software and related services. By creating an account, accepting an order or subscription, or using the service, you agree to these Terms and any additional policies or agreements that apply to your use of Worklix.
If you use Worklix for an organization, you represent that you are authorized to accept these Terms on that organization’s behalf. If you do not agree to these Terms, do not use the service.
2. Eligibility and account registration
Users must be legally able to enter into a binding agreement and must provide accurate account information. Organizations are responsible for identifying authorized administrators and for keeping account, billing and contact information current.
Login credentials must be kept confidential. You are responsible for activity performed through your account unless the activity results from a security failure caused by Worklix. Notify Worklix promptly if you believe an account or credential has been compromised.
3. Customer administrators and authorized users
A customer may allow employees, contractors, managers, administrators or other authorized users to access Worklix. The customer controls who is invited, which roles are assigned and which workspace information authorized users can access.
Customers are responsible for configuring permissions appropriately, removing access when it is no longer needed and ensuring that users comply with these Terms and applicable internal policies.
4. Workforce monitoring responsibilities
Worklix includes features that may process time, attendance, application or website activity, screenshots, productivity signals, device records and other workforce information depending on the customer’s configuration.
Customers are responsible for determining whether and how those features may lawfully be used in their workplace. This includes providing notices, obtaining consents or acknowledgements where required, respecting working-hour and off-duty rules, consulting applicable employment and privacy law, and avoiding monitoring that is unlawful or disproportionate to the stated business purpose.
5. Acceptable use
You may not use Worklix to violate law, infringe rights, harass or discriminate against individuals, introduce malicious code, gain unauthorized access, interfere with service availability, reverse engineer the service except where applicable law expressly permits it, resell or sublicense access without authorization, or use the platform to collect information in a manner prohibited by applicable law.
Additional prohibited conduct may be described in the Acceptable Use Policy, which forms part of the rules governing use of the service.
6. Subscriptions, fees and billing
Paid features may be offered through monthly, annual or other subscription periods. Prices, included features, usage limits and billing terms are shown at purchase or in an applicable order. Unless otherwise stated, applicable taxes and similar government charges are the customer’s responsibility.
Customers are responsible for keeping payment information current and paying amounts when due. If payment cannot be processed, access to paid features may be limited or suspended after reasonable notice where permitted.
7. Trials, free plans and changes to plans
Worklix may offer trials, free plans, promotional access or limited-feature versions of the service. Eligibility, duration, limits and included features may change or end according to the terms presented with the offer.
Customers should review current plan details before relying on a particular feature, limit or price. Worklix may update plans or pricing prospectively and will provide notice where required by applicable law or an existing commercial agreement.
8. Customer content and workforce data
Customers retain their rights in information and content they submit to Worklix. The customer grants Worklix the rights reasonably necessary to host, process, transmit, display and otherwise handle that information for the purpose of providing, securing and supporting the service.
Customers represent that they have the rights and lawful basis needed to provide the information they submit or configure for processing through Worklix.
9. Worklix intellectual property
Worklix and its licensors retain rights in the platform, software, interface, documentation, branding, designs and other technology provided as part of the service, excluding customer content.
These Terms provide a limited, non-exclusive, non-transferable right to use the service during the applicable subscription or authorized access period. No ownership of Worklix technology is transferred to the customer.
10. Third-party services and integrations
Worklix may allow connections to third-party products or services. A customer’s use of a third-party service is governed by that provider’s terms and privacy practices.
Worklix is not responsible for third-party products merely because they can connect to the platform. Customers should evaluate permissions and data sharing before enabling an integration.
11. Product changes and availability
Worklix may improve, modify, replace or discontinue features as the platform develops. We aim to maintain a useful and reliable service, but online software can experience maintenance, outages, network failures, third-party dependency issues or events outside reasonable control.
Where a material change affects a paid service, Worklix will provide notice when required by law or the applicable agreement.
12. Suspension
Worklix may suspend access when reasonably necessary to protect the service, other users or data; respond to suspected fraud, abuse or unlawful activity; address a serious security risk; or respond to non-payment.
When practical, Worklix will attempt to provide notice and an opportunity to resolve the issue unless immediate suspension is necessary for security, legal or operational reasons.
13. Termination
Customers may stop using Worklix and may cancel subscriptions according to the plan or order terms that apply to the account. Worklix may terminate or restrict access for material breach, unlawful use, repeated non-payment or other grounds permitted by these Terms or applicable law.
After termination, access to the service may end and customer data may be deleted or retained according to the Privacy Policy, account settings, applicable law and any contractual retention obligations.
14. Disclaimers
Except to the extent prohibited by law or expressly stated in a separate written agreement, Worklix is provided on an “as available” basis. Worklix does not guarantee that every feature will be uninterrupted, error-free or suitable for every legal, employment, compliance or business requirement.
Customers remain responsible for workplace policies, employment decisions, legal compliance and the way workforce data is interpreted and used.
15. Limitation of liability
To the extent permitted by applicable law, Worklix will not be responsible for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, business opportunities or data arising from use of the service, except where such limitations are not legally enforceable.
Any contractual limitation applicable to a paid customer may also be stated in an order, subscription agreement or other written commercial agreement.
16. Changes to these Terms
Worklix may update these Terms to reflect product changes, legal requirements or changes to business practices. When changes are material, Worklix may provide notice through the website, service or another appropriate communication channel.
Continued use of the service after updated Terms take effect constitutes acceptance to the extent permitted by law. If you do not agree to an update, you should stop using the service and cancel the affected subscription.
17. Contact
Questions about these Terms can be sent to dpromotix@gmail.com. For account or billing questions, include the account or company name and enough context for the request to be routed appropriately. Do not send passwords or highly sensitive credentials by email.
